These Official Giveaway Rules (the “Official Rules”) govern each giveaway or sweepstakes offered by Pin Book LLC on the @PinBookApp Instagram account that links to these Official Rules (each, a “Promotion”). Each Promotion is a game of chance and not a contest of skill.
The Instagram post announcing a Promotion (the “Promotion Post”) will identify the prize, approximate retail value, start and end dates and times, entry method, entry limit, and any additional Promotion-specific terms. The Promotion Post is incorporated into these Official Rules. If a Promotion Post conflicts with these Official Rules, these Official Rules control, except that the Promotion Post controls the Promotion-specific prize, approximate retail value, Promotion Period, entry method, and entry limit.
By entering a Promotion, each entrant confirms that they have read, understood, and agreed to these Official Rules and the applicable Promotion Post.

Pin Book LLC is referred to in these Official Rules as the “Sponsor.”
2. Eligibility
Unless the Promotion Post expressly states otherwise, each Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry.
Employees, members, managers, officers, directors, contractors, agents, and representatives of the Sponsor, and members of their immediate families or households, are not eligible to enter. For purposes of these Official Rules, “immediate family” means a spouse, domestic partner, parent, legal guardian, child, sibling, or the spouse or domestic partner of any of those persons.
A Promotion is void outside the fifty (50) United States and the District of Columbia and wherever prohibited or restricted by law. Eligibility is subject to all applicable federal, state, and local laws and regulations.
3. Promotion Period
Each Promotion begins and ends on the dates and at the times stated in the applicable Promotion Post (the “Promotion Period”). Unless the Promotion Post states otherwise, all times are Pacific Time.
The Sponsor’s systems and records are the official timekeeping method for a Promotion. Entries received before or after the Promotion Period are void.
4. How to Enter
During the Promotion Period, follow the entry instructions in the applicable Promotion Post. Unless otherwise stated in that Promotion Post, an entrant may be required to:
Like the Promotion Post; and
Post a comment on the Promotion Post tagging three eligible Instagram account belonging to a real person.
Each qualifying comment that tags three different eligible accounts will count as one (1) entry, up to the maximum number of entries stated in the Promotion Post. If no maximum is stated, the limit is five (5) entries per person and Instagram account.
The tagged account must belong to a real person whom the entrant reasonably believes would be interested in Pin Book or pin collecting. An entrant may not tag themselves, the Sponsor, a celebrity, a public figure, a business or brand account, an automated account, a fictitious account, or an account created or used primarily for sweepstakes entries. Entrants must not tag people indiscriminately, repeatedly tag the same person, or engage in harassing, deceptive, or spam-like conduct.
Unless the Promotion Post expressly makes following @PinBookApp an entry requirement, following @PinBookApp is not required to enter or win.
There is no purchase requirement and no entry fee. Normal internet or mobile-data charges imposed by an entrant’s service provider may apply and are the entrant’s responsibility.
5. Optional Instagram Story Bonus Entry
If the Promotion Post offers a bonus entry for sharing the Promotion Post to an Instagram Story, an entrant may receive one (1) bonus entry by sharing the Promotion Post to their Instagram Story during the Promotion Period and tagging @PinBookApp in the Story.
The Story must remain publicly viewable for at least twenty-four (24) hours or until the end of the Promotion Period, whichever occurs first. Entrants with private accounts, or whose Story cannot otherwise be verified by the Sponsor, must send @PinBookApp a direct-message screenshot showing the qualifying Story before the Promotion Period ends. The screenshot must reasonably show the entrant’s Instagram handle, the shared Promotion Post, the @PinBookApp tag, and the date or time of the Story. A screenshot submitted after the Promotion Period will not qualify.
Only one (1) Story bonus entry is available per person and Instagram account unless the Promotion Post expressly states otherwise.
6. Entry Restrictions
Entries must comply with these Official Rules, the applicable Promotion Post, Instagram’s terms and policies, and all applicable laws. Entries generated by script, macro, bot, automated process, entry service, or other fraudulent or mechanical means are void.
An entrant may use only one (1) Instagram account for a Promotion. Multiple entrants may not share the same Instagram account. Any attempt to obtain more than the permitted number of entries by using multiple or false identities, accounts, email addresses, devices, or other methods may result in disqualification of all associated entries.
Incomplete, late, misdirected, deleted, inaccessible, unintelligible, or noncompliant entries are void. Proof of posting or transmission is not proof that the Sponsor received or verified an entry.
The Sponsor may disqualify any entrant who, in the Sponsor’s reasonable judgment, tampers with a Promotion; violates these Official Rules; acts fraudulently, abusively, or disruptively; harasses another person; or attempts to undermine the legitimate operation of a Promotion.
7. Prize and Approximate Retail Value
The prize and its approximate retail value (“ARV”) will be stated in the applicable Promotion Post. The prize will be awarded only as described, except that the Sponsor may substitute a prize of equal or greater value if the advertised prize becomes unavailable for reasons beyond the Sponsor’s reasonable control.
The prize is non-transferable and may not be redeemed for cash, exchanged, or replaced at the winner’s request. Any difference between the stated ARV and the actual value of the prize will not be awarded. The winner is responsible for all costs not expressly included in the prize description.
All prize details not stated in the Promotion Post are determined by the Sponsor in its reasonable discretion. The prize is awarded “as is” without any warranty from the Sponsor, express or implied, except for any warranty that cannot lawfully be excluded. Any manufacturer’s warranty, if available, is provided solely by the manufacturer.
8. Random Drawing and Odds
After the Promotion Period ends, the Sponsor or its designee will select one (1) potential winner at random from all eligible entries received, unless the Promotion Post states that more than one winner will be selected.
The odds of winning depend on the number of eligible entries received. The Sponsor’s decisions concerning eligibility, entry verification, winner selection, and administration of the Promotion are final and binding to the extent permitted by law.
9. Winner Notification and Verification
The potential winner will be contacted only by the official @PinBookApp Instagram account, generally by direct message, within the timeframe stated in the Promotion Post or, if no timeframe is stated, within five (5) business days after the drawing.
Pin Book LLC will never require a winner to pay a fee, purchase anything, provide a credit-card or bank-account number, send cryptocurrency, or provide an account password to claim a prize. Entrants should disregard and report messages from impersonator accounts.
The potential winner must respond within forty-eight (48) hours after the Sponsor’s first notification attempt, unless a different response period is stated in the notification. The potential winner may be required to provide their full name, age or date-of-birth confirmation, mailing address, email address, and other information reasonably needed to confirm eligibility and deliver the prize. The Sponsor will not request sensitive financial account credentials to award the prize.
Before receiving the prize, a potential winner may be required to sign and return an affidavit or declaration of eligibility, liability release, publicity release where lawful, and any tax documentation required by law. A potential winner is not an official winner until the Sponsor verifies eligibility and compliance with these Official Rules.
If a potential winner cannot be contacted, fails to respond on time, declines the prize, is ineligible, fails to complete required documents on time, or otherwise violates these Official Rules, the potential winner forfeits the prize. The Sponsor may select an alternate potential winner by random drawing from the remaining eligible entries.
10. Delivery, Risk of Loss, and Unclaimed Prizes
Unless the Promotion Post states otherwise, prizes will be shipped only to a valid physical mailing address within the fifty (50) United States or the District of Columbia. The Sponsor will pay standard outbound shipping costs selected by the Sponsor.
The winner is responsible for providing a complete and accurate delivery address. The Sponsor is not responsible for a prize that is delayed, returned, misdelivered, or undeliverable because the winner supplied incorrect or incomplete information, failed to accept delivery, or failed to respond to a carrier notice.
If a prize arrives materially damaged, the winner must notify the Sponsor at [GIVEAWAY CONTACT EMAIL] within seven (7) calendar days after delivery and provide reasonable photographs of the packaging and item so the Sponsor can evaluate the matter. Any replacement is subject to availability and applicable law.
11. Taxes
The winner is solely responsible for all federal, state, and local taxes and any other charges arising from acceptance or use of the prize. The Sponsor may issue or require completion of tax forms when required by law.
12. Publicity
Except where prohibited by law, by accepting a prize the winner grants the Sponsor permission to announce and use the winner’s first name, last initial, city and state, Instagram handle, likeness, voice, and prize information for purposes of administering, announcing, and promoting the Promotion and the Sponsor, in any media, without additional compensation or approval.
Nothing in this section requires the winner to transfer ownership of content the winner created. Any use of entrant-created content beyond identifying or announcing the winner will be subject to applicable law and any additional permission reasonably required by the Sponsor.
13. Privacy
Information submitted or collected in connection with a Promotion will be used to administer the Promotion, verify eligibility, communicate with entrants and the winner, deliver the prize, prevent fraud, comply with law, and exercise or defend legal rights. The Sponsor will handle personal information in accordance with its Privacy Policy, available at www.pinbookapp.com/privacy.
Entry into a Promotion does not, by itself, enroll an entrant in marketing emails or text messages. The Sponsor may disclose information to service providers that assist with Promotion administration, shipping, legal compliance, or fraud prevention, subject to appropriate restrictions, and when otherwise required by law.
14. Release and Limitation of Liability
To the fullest extent permitted by law, each entrant agrees to release and hold harmless the Sponsor, Instagram, Meta Platforms, Inc., any prize supplier or promotional partner identified in the Promotion Post, and each of their respective parents, subsidiaries, affiliates, members, managers, officers, directors, employees, contractors, representatives, and agents (collectively, the “Released Parties”) from claims, demands, losses, liabilities, damages, costs, and expenses arising out of or relating to the entrant’s participation in a Promotion or the acceptance, possession, use, misuse, loss, or delivery of a prize.
To the fullest extent permitted by law, the Released Parties are not responsible for: (a) incorrect or inaccurate entry information; (b) technical, network, telephone, computer, hardware, software, platform, or transmission failures; (c) interrupted or unavailable internet, Instagram, or other services; (d) unauthorized human intervention; (e) lost, late, incomplete, corrupted, inaccessible, stolen, misdirected, or deleted entries or communications; (f) errors in the administration, processing, or announcement of a Promotion; or (g) injury or damage to a person or property resulting from participation in a Promotion or acceptance or use of a prize.
Nothing in these Official Rules excludes or limits liability that cannot legally be excluded or limited, including liability arising from a Released Party’s fraud, willful misconduct, or gross negligence where such liability cannot be waived under applicable law.
To the fullest extent permitted by law, each entrant agrees to defend, indemnify, and hold harmless the Sponsor from third-party claims, damages, liabilities, and reasonable costs arising directly from the entrant’s fraud, unlawful conduct, infringement of another person’s rights, or material breach of these Official Rules. This indemnity does not apply to the extent a claim was caused by the Sponsor’s own conduct or where indemnification is prohibited by law.
15. Modification, Suspension, or Cancellation
If fraud, tampering, technical failure, platform action, natural disaster, public emergency, legal restriction, or another event beyond the Sponsor’s reasonable control materially impairs the integrity or proper operation of a Promotion, the Sponsor may, to the extent permitted by law, suspend, modify, or cancel the Promotion.
If a Promotion is terminated early, the Sponsor may select the winner by random drawing from the eligible, non-suspect entries received before the impairment occurred, if doing so is fair, feasible, and lawful. The Sponsor will not materially change the Promotion in a manner that unfairly disadvantages entrants after the Promotion has begun.
16. Intellectual Property and Third-Party Trademarks
Pin Book, Pin Book, the Pin Book name and logo, and related branding are owned by or licensed to Pin Book LLC. All other names, characters, logos, product names, trademarks, and copyrights referenced in a Promotion belong to their respective owners.
Unless expressly stated otherwise in the Promotion Post, a Promotion involving a Disney-branded or other third-party collectible is not sponsored, endorsed, administered by, or associated with The Walt Disney Company or any other referenced trademark or copyright owner. The identification of a prize is for descriptive purposes only and does not imply affiliation, sponsorship, or endorsement.
17. Instagram and Meta Disclaimer
Each Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. By entering, each entrant completely releases Instagram and Meta Platforms, Inc. from claims arising out of or related to the Promotion, to the fullest extent permitted by law.
Entrants understand that they are providing their information to the Sponsor and not to Instagram or Meta Platforms, Inc. Any questions, comments, or complaints about a Promotion must be directed to the Sponsor and not to Instagram or Meta Platforms, Inc.
The Sponsor is solely responsible for the lawful operation of each Promotion. Instagram and Meta Platforms, Inc. do not assist with, administer, advise on, or assume responsibility for the Promotion.
18. Disputes and Governing Law
Except where prohibited by law, each entrant agrees that:
Any dispute, claim, or cause of action arising out of or relating to a Promotion or prize will be resolved individually, without resort to any form of class, collective, or representative action;
Any claim, judgment, or award will be limited to actual out-of-pocket costs incurred in entering the Promotion, excluding attorneys’ fees, and no entrant may recover punitive, incidental, special, consequential, or multiplied damages, or damages for loss of profits or opportunity, to the extent such limitations are permitted by law;
California law governs the Promotion and these Official Rules, without regard to conflict-of-law principles; and
Any court proceeding that is not properly brought in small claims court must be brought in a state or federal court located in Los Angeles County, California, and the entrant consents to the jurisdiction of those courts.
Nothing in this section deprives an entrant of nonwaivable rights or remedies available under applicable law.
19. Severability; No Waiver
If any provision of these Official Rules is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect. The Sponsor’s failure to enforce any provision is not a waiver of that provision or any other provision.
20. Winner Information
Where required by law, a person may request the winner’s first name, last initial, city, and state by emailing support@pinbookapp.com with the subject line “Winner Information Request — [PROMOTION NAME]” within sixty (60) days after the Promotion ends.
The Sponsor may announce the winner on @PinBookApp after verification. The Sponsor will not publicly post the winner’s full mailing address, email address, telephone number, or other sensitive contact information.
